1. Agreement to these Terms
These Terms & Conditions ("Terms") govern access to and use of the Let's Catch Up mobile applications, website, and related services (collectively, the "Platform") operated by KANDHUGULE CONSULTANCY SERVICES PRIVATE LIMITED ("KCS", "we", "us", or "our"). By creating or using an account, accepting these Terms, or using the Platform, you agree to these Terms and the Privacy Policy. If you use the Platform for a school or organization, you confirm that you are authorized to do so. If you do not agree, do not use the Platform.
Electronic acceptance, consent records, notices, and communications may be used to administer these Terms to the extent permitted by law. These Terms do not reduce mandatory consumer, child-safety, employment, education, or data-protection rights.
2. Platform services
Let's Catch Up is a multi-role platform that may provide:
- school administration, student information, classes, timetables, attendance, assignments, assessments, results, certificates, fees, reports, and parent communication;
- school transport administration, driver trip workflows, pickup and drop-off status, and authorized live trip tracking;
- courses, learning resources, meetings, messaging, notifications, collaboration, and support; and
- private institutional communities and, where offered, public professional or social features for eligible adult users.
Available features depend on role, institutional configuration, subscription, device, region, permissions, and applicable law.
3. Eligibility and authority
- School accounts may be created, invited, or managed by an authorized educational institution. Students may be minors and must use the Platform under the authority of their school and, where required, a parent or legal guardian.
- Parents and guardians must be authorized to access the linked student record and must not attempt to access another child's information.
- Teachers, staff, administrators, drivers, and other personnel must be authorized by the relevant institution for their assigned role.
- Public social or professional features are available only to users who are at least 18 years old. You must not misrepresent your age or identity to access them.
4. Accounts and security
- Provide accurate, current, and complete information.
- Keep credentials, one-time passwords, and authenticated devices secure and do not share an account unless expressly permitted.
- Promptly notify the school or KCS if you suspect unauthorized access, impersonation, or misuse.
- Use only the memberships, campuses, student links, classes, trips, and permissions assigned to you.
You are responsible for activity performed through your account to the extent permitted by law. Institutions remain responsible for promptly updating roles and removing access when it is no longer authorized.
One person may hold multiple authorized school, campus, or role memberships. Switching context does not transfer records or permissions between institutions. You must confirm the active role, campus, and linked student before taking an action.
5. Acceptable use
You must not:
- use the Platform unlawfully or violate another person's privacy, intellectual-property, contractual, or other rights;
- harass, threaten, bully, exploit, discriminate against, or impersonate another person;
- upload child sexual abuse material, sexual exploitation, illegal, defamatory, hateful, violent, deceptive, or harmful content;
- publish materially deceptive synthetic, manipulated, or AI-generated media without clear disclosure where a reasonable person could mistake it for an authentic person or event;
- cheat, plagiarize, falsify attendance, location, trip, assessment, payment, identity, or school records;
- introduce malware, overload or disrupt systems, bypass access controls, probe security, scrape data, reverse engineer, or use automated means except as expressly authorized;
- collect, disclose, or misuse student, guardian, employee, location, or institutional data without authorization; or
- use the Platform for unauthorized advertising, spam, resale, surveillance, or commercial exploitation.
6. School and child safety
School spaces are controlled environments subject to the institution's policies, safeguarding obligations, and role-based access. Institutions are responsible for obtaining required permissions or parental consent, maintaining accurate authorized users and guardian links, configuring campus, attendance, fees, transport, and academic settings, supervising educational use, and responding to school safety matters. KCS may preserve, restrict, and report content or activity when required by law or reasonably necessary to protect a child or another person from harm.
7. Academic integrity and records
Students must submit honest, original work and follow their institution's academic rules. Teachers and institutions are responsible for curriculum, grading, attendance decisions, assessment standards, record accuracy, and correction processes. Platform calculations and reports support institutional workflows but do not replace authorized academic judgment.
8. Transport, attendance, and location
- Drivers may use location-enabled trip features only for an assigned school vehicle and active trip and must follow road, safety, employment, and school transport requirements.
- Drivers must not interact with the app while driving unless it is lawful and safe; required actions should be completed while stationary or by an authorized attendant.
- Users must not spoof, manipulate, or falsify location, attendance, pickup, drop-off, route, or trip status.
- Live positions, arrival information, and notifications may be delayed or inaccurate because of GPS, device, network, map, battery, traffic, or third-party conditions. They must not be treated as emergency-response services or the sole basis for a safety-critical decision.

9. Communications and meetings
Messaging, posts, calls, meetings, files, and notifications must be used only for authorized educational, institutional, or permitted community purposes. Participants must obtain any consent required before recording, capturing, or redistributing another person's communications. Institutions and KCS may moderate content and investigate reported misuse in accordance with applicable law, the Privacy Policy, and the Community Guidelines.
10. Fees, payments, and concessions
Schools or organizations determine applicable fees, due dates, concessions, refunds, and settlement records unless a separate written agreement states otherwise. Payments may be processed by third-party providers under their terms. Users must verify the payer, student, amount, and purpose before submission. The Platform must not be used to collect more than the displayed outstanding balance. Disputes about school fees should first be raised with the institution; payment-processing issues may also be subject to the provider's procedures.
11. User content
You retain ownership of content you create. You grant KCS a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit, display, and make technical adaptations to that content only as necessary to operate, secure, support, and improve the Platform and comply with law. You confirm that you have the rights and permissions required to submit the content. You must label synthetic or AI-generated content when required by law, the feature, or the Community Guidelines. This licence ends when the content is deleted from active systems, subject to backups, audit records, legal retention, and content shared with others before deletion.
12. KCS and third-party content
The Platform software, design, branding, documentation, and KCS content are owned by KCS or its licensors. Subject to these Terms, KCS grants you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose. Course materials and institutional content may belong to the relevant institution, teacher, publisher, or other owner. Third-party services, links, maps, app stores, payment providers, and integrations may have separate terms and policies. KCS is not responsible for third-party services outside its control.
13. Privacy and permissions
Our Privacy Policy explains how personal data—including foreground and background location—is accessed, collected, used, retained, and shared. Device permissions are requested when needed for relevant features. You may manage permissions in device settings, but some features may not function without them. Institutional users are also subject to their school's or organization's notices and lawful instructions.
14. Service availability and changes
We work to keep the Platform secure and available but do not guarantee uninterrupted or error-free operation. Maintenance, emergencies, connectivity, third-party failures, legal requirements, or security events may affect availability. We may add, change, suspend, or discontinue features and may require app updates for security, compatibility, or policy compliance. Where reasonably practicable, we will notify affected institutions or users of material service changes.
15. Moderation, suspension, and termination
KCS or the relevant institution may restrict content or access when reasonably necessary to enforce these Terms, protect users, investigate suspected misuse, address security or operational risk, comply with law, or act under an institutional agreement. Measures may include limiting distribution, removing content, preserving evidence, warning a user, or suspending a feature or account. Where appropriate and lawful, users may contact the institution or KCS to seek review. You may stop using the Platform or request account deletion, subject to institutional control, lawful record retention, unresolved transactions, investigations, and legal obligations. Provisions that by nature should survive termination will continue to apply.
16. Disclaimers
To the maximum extent permitted by law, the Platform is provided "as is" and "as available". KCS disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. KCS does not control or warrant institutional decisions, user content, curriculum, grades, transport operations, emergency response, internet connectivity, or independent third-party services. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
17. Limitation of liability
To the maximum extent permitted by law, KCS will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or loss of profits, revenue, opportunity, goodwill, or data arising from use of the Platform. KCS's total liability for claims relating to the Platform will not exceed the amount paid to KCS for the affected service during the twelve months before the event giving rise to the claim, or INR 1,000 if no amount was paid. These limits do not apply where prohibited by law, including liability that cannot legally be limited.
18. Indemnity
To the extent permitted by law, adult users and institutions agree to defend, indemnify, and hold KCS harmless from third-party claims, losses, and reasonable costs resulting from their unlawful use of the Platform, violation of these Terms, content they submit, or infringement of another person's rights. This section does not require a minor to provide an indemnity and does not apply to the extent a claim results from KCS's own breach or unlawful conduct.
19. Governing law and disputes
These Terms are governed by the laws of India. Before starting formal proceedings, the parties should attempt in good faith to resolve the dispute through the contact details below or the relevant institution. Subject to mandatory consumer or other applicable rights, courts with jurisdiction in Hyderabad, Telangana, India will have exclusive jurisdiction.
20. General provisions
- If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining Terms continue.
- Failure to enforce a provision is not a waiver. Headings are for convenience and do not affect interpretation.
- You may not transfer your account or these Terms without our written consent. KCS may assign these Terms as part of a merger, reorganization, financing, or transfer of the Platform, subject to law.
- These Terms, the Privacy Policy, Community Guidelines, and any applicable institutional or subscription agreement form the agreement governing use of the Platform. A negotiated written institutional agreement controls if it expressly conflicts with these general Terms.

21. Changes to these Terms
We may update these Terms when the Platform, law, or our practices change. We will post the revised effective date and provide additional notice or renewed acceptance when required. Continued use after an update takes effect constitutes acceptance where permitted by law. If you do not agree, stop using the Platform and contact the relevant institution regarding account access or required records.
